ECtHR rules lifting of immunities a violation 2022-02-01 14:50:27   DİYARBAKIR - The ECtHR ruled that the lifting of the parliamentary immunities of 40 HDP MPs and their prosecution is a violation.   On 20 May 2016, the European Court of Human Rights (ECHR) ruled that the lifting of the parliamentary immunities of 40 Peoples' Democratic Party (HDP) MPs and their prosecution is a violation. Attorney Mahsuni Kahraman shared the following from his Twitter following the announcement of the decision: "ECtHR decided that the freedom of expression of 40 HDP MPs has been violated when their immunity was lifted on May 20, 2016 with its Encü/Türkiye decision."   DEMİR: THEY MUST BE RELEASED   Attorney Ramazan Demir shared the following from Twitter: "ECtHR announced its decision regarding the lifting of the parliamentary immunities of 40 HDP MPs and said it was a violation. The final curtaion closed regarding the crime committed against the Kurdish movement by the government which was fully supported by the opposition. When evaluated with the decision of the Grand Chamber of ECtHR, Selahattin Demirtaş and 5 of his friends who shouldn't even be detained are in prison for the last 5 years. The proceedings that have ended should be reopened, the ongoing ones should be dropped, and the imprisoned MPs should be released immediately."
