Lawyers' requests in the Dedeoğulları attack case rejected 2023-09-19 14:50:54   ANKARA - In the case of attack on the Dedeoğulları family, which returned from the Court of Appeal with all provisions overturned due to improper collection of evidence, all requests previously submitted by the lawyers were rejected again.   7 members of the Dedeoğulları family, who were subjected to a racist attack by the Keleş and Çalık families in Konya's Meram district on May 12, 2021, were murdered by Mehmet Altun on July 30 as a result of not taking precautions, although they appealed to the police after the attack and stated that their life was not safe. The decision of the assault case heard at the Konya 8th High Criminal Court was overturned by the 1st Criminal Chamber of the Konya Regional Court of Justice. The second hearing of the case, which was reheard after the reversal decision, was held at Konya 8th High Criminal Court. Greens and Left Future Party (Green Left Party) Mersin MP Ali Bozan attended the hearing, while Lawyers Association for Freedom (ÖHD) lawyers, Çetin Dedeoğulları and relatives of the family were also present at the hearing.   There is no detained defendants were tried in the case where Ali Keleş, İbrahim Keleş, Veli Keleş, Ali Keleş, Lütfi Keleş, Yapya Çalık, Ali Çalık and Ramazan Çalık were tried on the grounds of "violation of residence immunity", "attempted murder", "damage to property" and "injury".   'I INVITE YOU TO DO YOUR DUTY'   The hearing started after identification. Lawyer Atilla Kart was the first to speak at the hearing. Kart stated that the reason for the overturning of the provisions was the evidence collected illegally and said: “Could there be such legal frivolity? "We invite you to do your duty after all provisions are overturned."   REQUESTS ARE SUBMITTED AGAIN   Lawyer Sipan Cizreli, who took the floor afterwards, listed the requests they made before the reversal decision, but were not accepted, as follows:   “*The contradictory statements made by police officers Mustafa Aras and Günay Yüksel, who were heard as witnesses, during the hearing, the constant messaging of the officers in the HTS records, the continuous messaging of police officer İlyas Boztaş, who was not at the scene and stated to be on transferred duty, from 23.35 to 03.25 on the day of the incident. He should be heard as a witness since it was understood that his messaging with Aras actually involved him in the incident,   * Public Prosecutor Mustafa Ali Öğütçü was heard as a witness on the grounds that the defendants and the suspects who were given KYOK stated in their Whatsapp correspondence that they said: "We met with the prosecutor, two people should take the blame" and that they declared this prosecutor as Public Prosecutor Mustafa Ali Öğütçü,   * Notifying the HSYK, as the investigation prosecutor has been found to be guilty of negligence and abuse of duty,   * Conducting discovery because the alleged plot in the file is contrary to the rules, as claimed by the other party on the night of the incident, and contradicts the evidence,   * Since it is understood that the applications made to the Constitutional Court and the Ministry of Justice will shed light on this file, the applications are expected to be awaited,   * The conversation between the accused hitman murderer Mehmet Altun and 112 in the file numbered 2021/385 of the Konya 4th High Criminal Court was brought to the file,   * Filing a criminal complaint against the relevant law enforcement officers for clarifying the incident as a result of disrupting the crime scene for security reasons upon the law enforcement's confession after the incident,   * Filing a criminal complaint against administrative and judicial officials who did not take the necessary precautions after the incident,   * A criminal complaint should be filed against Ahmet Ardıç, who called 112 on the night of the incident and declared in your court that he was at the scene of the incident, for trying to mislead the court in the HTS records and for trying to prevent a fair trial,   * As it is understood that the persons who called 112 on the night of the incident were the victims Serpil Dedeoğulları and Ahmet Ardıç, and that Ahmet Ardıç give false testimony, we request that the persons who called 112 on the night of the incident be identified and their statements taken as witnesses.``   REJECTION OF LAWYERS' REQUESTS   The court, which ruled for the continuation of the judicial control measure in the form of a travel ban against the defendants Ali Keleş, İbrahim Keleş, Veli Keleş, Ali Keleş, Lütfi Keleş, Yahya Çalık, Ali Çalık, Ramazan Çalık separately, called police officer İlyas Boztaş and Public Prosecutor Ali Öğütçü as witnesses. It decided to reject the requests for the conversation between the shooter Mehmet Altun and his 112 personnel to be added to the file and postponed the hearing to January 18.   'KURDS WILL NOT BE COME TO HEEL'   After the hearing, the Dedeoğulları family and their lawyers and Green Left Party (Green Left Party) Mersin MP Ali Bozan made a press statement in front of the house where the family was murdered and turned it into a museum of shame. Drawing attention that the massacre took place because the evidence in the attack was obscured by the state, Lawyer Atilla Kart said: “Kurds will not come to heel. They will continue their march for rights, law and justice. In our opinion, the 7 people who died are martyrs of democracy. Kurds will not come to heel; They will continue this struggle until they build the law of rights, law, justice and equal citizens."
