Kazanhan file at Supreme Court: An effective investigation must be conducted 2019-09-30 09:58:19   ŞIRNAK - The 13 yeaes 4 months of prison and acquittal decision about the police who killed 12 year old Nihat Kazanhan in Cizre, was transferred to the Constitutional Court after the application to the Court of Cassation was rejected. The application stated that there was a violation of the right to life  and a violation of the right to a fair trial, and an effective investigation was requested.       Police officer H.V. was sentenced to 13 years and 4 months' imprisonment for the special operation police Mehmet Nurbaki Göçmez in connection with the death of 12-year-old Nihat Kazanhan who was shot while playing outside his house on January 14, 2015 in Cizre district of Şırnak. The appeal against the acquittal decision was rejected by the Court of Cassation some time ago. The 1st Criminal Chamber of the Court of Cassation ruled the decision taken by the 1st Heavy Penal Court of Cizre "just".     Attorneys of the Kazanhan file applied to Constitutional Court for a reversal of the Supreme Court decision. The application was done with the reason 'violation of right to life', "violation of the obligation to conduct an effective investigation in the context of the right to life" and "violation of the right to a fair trial". Kazanhan's lawyers stated that Kazanhan was deliberately killed and the investigation was only carried out for one police officer and the other police officers were not included in the file.
