Mardin Bar Association President Elik: This draft violates the principle of equality

MARDİN - Stating that it is against the principle of equality to exclude the political prisoners from the execution arrangement, Mardin Bar President İsmail Elik defined the draft prepared by the government as 'discriminatory'.
 
Koronavirus (Covid- 19) that claims the lives of scores of citizens everyday while the number of confirmed cases increase on a daily basis, more than 300 thousand prisoners are at risk as a reslut of the outbreak. While almost every day calls are made from many circles regarding the release of the detainees in prisons without discrimination, the AKP aims to exclude political prisoners with its 3rd Judicial Package that includes an execution arrangement.
 
İsmail Elik, the President of the Mardin Bar Association, who made evaluations on the subject, said he did not find the draft 'satisfactory'.
 
VIOLATES THE PRINCIPLE OF EQUALITY
 
Stating that the government has prepared a draft incompatible with the European Court of Human Rights (AHIM) jurisprudence, the European Convention on Human Rights (AHIS) and violating the principle of equality of the Constitution, Elik said: "The draft is far from being satisfactory. There is no indication of the people who are jailed pending trial in the draft. Thousands of people today has pending trials. They are still in prison because they are jailed pending trial. There is no regulation for them in the draft. This is a big deficiency and in violation of the principle of equality. This draft is discriminatory."
 
'THEY TURNED THE VIRUS INTO AN OPPORTUNITY'
 
 
Noting that "crimes" committed against the state are prioritized in democratic countries and legal practices, Elik said: "The government has to include the crimes committed against the state in the amnesty or execution regulation. The alleged crimes against the state have been excluded while the crimes against persons were included. This is the opposite of the practices that should be in a state of law."
 
Mentioning that drug and sexual abuse crimes are included in the execution regulation, Elik said: "The government and its partner have turned the virus outbreak into an opportunity. Bar associations, NGOs and all segments of the society should speak up on this issue."
