Kaya whose acquittal upheld in the case of the trustee

DİYARBAKIR - Erxenî Municipality Co-Mayor Ahmet Kaya, whose acquittal was upheld in the case in which a trustee was appointed as the reason for the appointment of a trustee, said: "There is no legal obstacle for his reinstatement. They should correct the mistake."
 
Ahmet Kaya, who was nominated by the Peoples' Democratic Party (HDP) for the mayoralty of the Erxenî (Ergani) district of Amed in the local elections on March 31, 2019 and was elected with 55.85 percent of the vote, was dismissed by the Ministry of Interior on March 23, 2020. A trustee was appointed to replace Kaya, who was dismissed due to investigations initiated against him.
 
Later, a lawsuit was filed against Kaya with the allegation of "being a member of a terrorist organization" on the grounds of events such as the candidate promotion meeting, Newroz celebration, and condolence visit. Kaya was acquitted in the case filed at the Diyarbakır 8th High Criminal Court. The decision became final on April 7 due to the lack of appeal. Kaya's lawyers applied to the Ministry of Interior through the Diyarbakır Governor's Office. Kaya was asked to be reinstated as mayor.
 
The governor's office applied to the same court, claiming that they "did not know about the verdict" and demanded that "the possibility of being involved in the case and the possibility of public harm" be evaluated and the annotation of finalization removed. After the verdict was finalized, an application was made for Kaya's reinstatement.
 
'THE DECISIONS ARE POLITICAL'
 
Saying that the trustee cases are political, Kaya said: "Although there is no obstacle in front of his reinstatement, they cannot predict whether he will be reinstated or not. The trustees were 'transferring money to terrorists' and 'financing to the terrorist organization'. These were fake. The prosecution itself says, 'This file is empty, there is no tangible claim in this file.' There is one thing that becomes clear for us in that respect. Trustee decisions are purely political.
 
Noting that they will apply to the Administrative Court in case of a negative response to reinstatement, Kaya said: "Then, if the domestic remedies are exhausted, we will initiate the AYM and the ECtHR process. We will never let go of the outcome of this case. All of our friends will also apply to the end because we must decipher the trustee regime in every aspect and at every level."
 
Stating that the functioning of the new cabinet will be clear with the response to his application, Kaya continued as follows: "A wrong decision will be made because the law does not apply, but we hope that the mistake will be reversed. The cases of other friends have also resulted in acquittal. All trustee cases should be abolished as soon as possible. These incidents should be ended."
